Man Gets 170 Days In Jail For Fatal DWI Crash
Loophole In Law Prevented Longer Jail Sentence

KANSAS CITY, Mo. -- A 40-year-old Parkville man was sentenced to 170 days in jail for an alcohol-related crash that killed a 19-year-old man last year.Michael W. Binggeli pleaded guilty Thursday. His sentence is 10 days less than the 180-day maximum sentence for a class B misdemeanor. Platte County prosecutor Eric Zahnd said a loophole in the law prevented a longer jail sentence for Binggeli.Louis Calandrino Jr. was killed in March 2004 when his car was hit by Binggeli at 64th Street and Riss Lake Drive.
Court documents showed that Binggeli had two prior convictions in 1992 and 1997 for driving with excessive blood alcohol content."This case is a tragedy that ended a young man's life and uncovered the weaknesses of Missouri's DWI laws," Zahnd said a press release.At the time of the crash, Missouri law stated that a third DWI was a felony only if two prior alcohol-related incidents occurred within 10 years of the charged offense. Binggeli was eligible only to be charged with a class B misdemeanor.The death led Zahnd and Calandrino's parents to fight for tougher laws against repeat DWI offenders. A new bill was passed eliminating the 10-year-old limit for using past alcohol-related incidents and increasing the penalties for repeat DWI offenders. The law became effective Aug. 28.
